A marketing consultant contract is a legal agreement between the marketer and the firm that is contracting the freelance marketer. The below template is how Pinfinite Marketing outlines a particular marketing project and how involved parties will work together.

MARKETING CONSULTING AGREEMENT

Company Services with Client includes:

1. Pinterest business account setup/cleanup and management

2. Tailwind SmartLoop, Tribes, and pre-scheduling optimization

3. Pin and infographic designs for blogs and website content

4. AB testing of pins to generate viral content

5. Promoted pin management (up to 5 pins); Minimum $5 ad spend

6. SEO and content strategy development to build your brand + increase sales

7. Keyword search, content gap analysis and competitor analysis

8. Auditing + managing content to schedule and post on Pinterest

PINFINITE MARKETING TERMS OF AGREEMENT


By signing this agreement on this page and below, Client is entering into a legally binding agreement with Company according to the following terms and conditions:


COMPANY'S SERVICES.


Upon execution of this Agreement, electronically, verbally, written or otherwise, the Company agrees to render services related to marketing consulting (the "Service"). The terms of this Agreement shall be binding for any further services supplied by Company to Client. Parties agree that the Service is in the nature of marketing consulting. The scope of services rendered by Company pursuant to this contract shall be solely limited to those contained therein and provided for on Company's website as part of the Service.


COMPENSATION.


Client agrees to compensate Company according to the payment schedule set forth on Company's website, PayPal, or Payment Schedule and the payment plan selected by Client (the "Fee") or otherwise noted in this agreement. Company shall charge a 5% (five-percent) late penalty to all balances that are not paid in a timely manner by Client.


REFUNDS.


Upon execution of this Agreement, Client shall be responsible for the full extent of the Fee. No refunds will be provided.



CANCELLATION:


Client may cancel the Service at anytime.


LIMITATION OF LIABILITY.


By using Company's services and enrolling in the Service, Client releases Company from any and all claims, actions, losses, expenses, costs or damages that may result from anything and everything. Client accepts any and all risks, foreseeable or non-foreseeable, arising from such transactions. Client agrees that Company will not be held liable for any damages of any kind resulting or arising from, including but not limited to; direct, indirect, incidental, special, negligent, consequential, or exemplary damages happening from the use or misuse of Company's services. Client agrees that use of Company's services is at Client's own risk.


DISCLAIMER OF GUARANTEE.


Client accepts and agrees Company cannot guarantee or promise any results. Nothing in this Agreement and nothing in what we say or do can be construed as a guarantee about the outcome of your results. Our past or future comments about the outcome of your matter or opinions are not guarantees.


CONFIDENTIALITY.


The term "Confidential Information" shall mean information which is not generally known to the public relating to the Client's business affairs. Company agrees not to disclose, reveal or make use of any Confidential Information learned of through its transactions with Client, during discussion with Client, or otherwise, without the written consent of Client. Company shall keep the Confidential Information of the Client in strictest confidence and shall use its best efforts to safeguard the Client's Confidential Information and to protect it against disclosure, misuse, espionage, loss and theft.


OTHER TERMS.


Upon signing below, the Parties agree that any individual, associate, and/or assign shall be bound by the terms of THIS AGREEMENT. An electronic, or e- mailed executed copy or acceptance of this Agreement, with a written or electronic signature or statement, shall constitute a legal and binding instrument with the same effect as an originally signed copy.
